Anhui port authority sued in first-ever court litigation

A local company in Fanchang county, Anhui province, has taken the local port authority to court on the basis of unfair fines. The first of its kind in the province since the implementation of the 2004 Port Law, the court heard the case in public and ruled in the port authority’s favour.

The case centred on the port authority’s discovery in September 2012 that the company, unnamed in the story published in China Waterway Newspaper last week, had been building a terminal in Heyu village without official approval. The port authority used its legal powers and ordered the company to dissemble the construction and restore the shoreline to its original state. Having already spent several million Renminbi, the company refused to accept the order. The port authority thus found itself defending its position in court.
